Terms of Service

These terms are an agreement between you and Duta ("we", "us"). They cover chatduta.com, every Duta link, and the apps and agents behind them (the "Services"). By using the Services you agree to these terms, our Usage Policy and our Privacy Policy. Please read them. This is plain-language template text; have it reviewed before you rely on it.

1. Who we are

Duta gives people ("creators") a link that answers their visitors with AI, and a small team of agents that drafts replies, follow-ups and bookings for the creator to approve. You can reach us at contact@chatduta.com.

2. Accounts

• You must be at least 18 to create a Duta. Visitors must be at least 13, or the minimum age where they live.
• Give accurate sign-in details and keep your account secure. You're responsible for what happens in it.
• Visitors can chat without an account, or sign in to save their chats.
• You can delete your account at any time: creators in Settings, visitors in My chats.

3. Using the Services

• Follow the Usage Policy. It's part of these terms.
• Creators are responsible for what they tell their Duta, the files they share, the instructions they give their agents and every email they approve.
• Only connect accounts, calendars and channels you're allowed to use. You can disconnect them any time.
• We may limit, pause or remove a link, file or account that breaks these terms or puts others at risk.

4. Messages, files and AI answers

• You own what you put in: your answers, files and messages. You let us store and process them to run the Services.
• A Duta is an AI. It answers from what the creator shared and can still be wrong. Visitors are told they're talking to an AI, not the person.
• Agents draft; people decide. Nothing is emailed or sent without the creator's approval, and bookings need it too unless the creator turns on instant booking.
• Don't rely on AI answers for medical, legal, financial or other professional advice.
• Times a visitor picks wait until the creator confirms, unless the creator turns on instant booking for their free times. Confirming adds the call to the creator's calendar and invites the visitor.

5. Feedback

If you send us ideas or feedback, we can use them to improve Duta without owing you anything.

6. Plans, usage and payment

• Duta has a Free plan and a paid Pro plan. Each comes with a monthly usage limit, shown in Plan & usage as a percentage of your limit.
• Usage resets every month: on the day you signed up for Free, or on your billing date for Pro. Unused usage doesn't carry over.
• Pro is paid upfront each month and renews automatically until you cancel. Cancel any time in Plan & usage, at least 24 hours before your renewal date to avoid the next charge. Pro stays on until the end of the month you paid for.
• You can buy extra usage at any time. It doesn't expire and is used only after your monthly limit runs out.
• When you reach your limit, your link keeps working and saves every message, but agents stop answering with AI until the month resets or you add more.
• Payments are handled by Dodo Payments, our merchant of record, whose terms also apply to the payment. Fees aren't refundable except where the law says otherwise; contact us if something went wrong.
• We'll tell you at least 30 days before we change a price you pay.

7. Other services

When you connect Google, Microsoft, Slack, Discord or a calendar, or pay through Dodo Payments, their own terms also apply. We aren't responsible for their outages or changes.

8. Our name and character

The Duta name, the pearl messenger character and the app's design are ours. Your share links and cards may show them; please don't use them for other products.

9. No warranty, limits on liability

• The Services are provided "as is". We work to keep them running and accurate, but we can't promise they'll always be available or error-free.
• To the extent the law allows, we aren't liable for indirect or lost-profit damages, and our total liability is limited to what you paid us in the 12 months before the claim (or $50 if you paid nothing).
• You agree to cover claims that come from content you add or emails you approve, to the extent the law allows.

10. Changes to these terms

If we change these terms, the Usage Policy or the Privacy Policy in a way that matters to you, we'll show a notice in the app and update the date above, usually at least 30 days before the change takes effect (sooner if the law or safety requires it). If you don't agree, you can stop using Duta and delete your account before then.

11. Ending the agreement

You can stop at any time by deleting your account. We may suspend or end access if you break these terms. Sections that by their nature should last (like ownership and limits on liability) continue after that.

12. Disputes

These terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-law rules. Before going to court, please email us so we can try to fix it together.
